Neil Dymott Hudson attorneys recently represented a physician who was sued for malpractice, fraud, and violation of privacy rights. The plaintiff claimed he was a patient of the physician, and the physician was liable when medical information was disclosed in a lawsuit. Shareholder Hugh McCabe filed a special motion to strike and argued the plaintiff's claims were a Strategic Lawsuit Against Public Participation (SLAPP) and were privileged. The court agreed. Not only was the case dismissed, but the court also awarded the physician attorney's fees against the plaintiff.
